Joint Scheduling Report

The Joint Scheduling Report due in the Bardfield case (which I mentioned here a couple weeks ago) has been filed:




There's a few new and interesting developments here, perhaps the most relevant being the proposed scheduling deadlines for the case:

Deadline to amend pleadings/add other parties to the lawsuit: September 24, 2010
Deadline for discovery to be completed by: October 15, 2010
Deadline to file dispositive motions: November 15, 2010

Proposed trial date: On or about the month of January 2011.
Typically, once a Joint Scheduling Report like this is approved and the private discovery period begins, the filings in a case become pretty quiet. So, if you see this blog become inactive for a spell, that's completely normal...it means there's nothing going on that we can see. An exception would be if there were discovery disputes; in that case we'd begin to see motions related to discovery issues (as happened in the DeForest case, for example).

So, just a heads up, we may be in for an extended quiet period here on The Forest Moon of Endor. Or not. We shall see...

So, the new schedule for the rest of the DeForest case looks like:

Deadline to add parties/amend pleadings: September 15, 2010
Discovery completed by: November 15, 2010
Dispositive motions filed by: December 15, 2010
Proposed trial date: May 2011

  2. Yeah, there's a second Joint Report due in the DeForest case later this month. That'll have a new batch of deadlines too, so I'll post that as soon as it becomes available.

  3. Does this mean that all the JustCircuit goons will be subpoenaed, such as Thomas Suckler, Victor Mauro and Shane Rogers? Sounds like between this lawsuit and the other noize stuff you have on here that they may be out of business soon.

  4. That would be up the lawyers and parties in the case as to who they'll subpoena for depositions, so who knows at this point (except for the lawyers and parties).

  6. Am I reading correctly in these documents that Johnny appears to be cooperating in the Barfield case and he and Bobby appear to be not cooperating in the DeForest case?

    Why would that be?

  7. Yeah, the cooperation looks more grudging in the DeForest case, and as to why that may be so I simply don't know. Feel free to supply your own theories here...

  8. Also, noticed that the documents were delivered to the same address that they were returned from the last time. I guess it's wait and see on whether these will be returned.

  10. Yes, 9/15 was the deadline to add parties and amend pleadings in the DeForest case, and there has been no recent filing. So, it looks like that case is now set as to parties and causes of action (although either side could make a motion to file past the deadline, if they felt they needed to).

    The Bardfield case has been quiet to date too, as to filings.

  12. There's been almost no activity.

    Specifically, no filing activity in the DeForest case at all since the above joint scheduling report, and some very minor activity relating to the appointment of a mediator in the Bardfield case. This was expected; see section (5) of the Bardfield joint scheduling report above.

    If you examine the deadlines set forth there, this stab at mediation is supposed to begin no later than October 29, and be wrapped up no later than November 12. So, if such efforts somehow manage to be productive, we should know by November 26 (the deadline for filing the mediation report).

    Like I warned above, this lull in filings is entirely expected at this point in both cases.
